(Please read carefully as they set out our respective rights and obligations. Once you begin your tour, by default, you accept these terms and conditions.)

Once 'Four Elements Adventure' confirms your booking, a contract is made between 'Four Elements Adventure' and 'you and your party' upon the terms and conditions set out below.

 

1. Booking

  1. Once 50% payment is made you will be allocated a place/places on the particular tour and a confirmation emailed to you. This is your confirmation of booking. This should be printed and saved for your own reference.

  2. Once you begin your tour, you accept and abide by these terms and conditions.

  3. We accept no responsibility for incorrect email or inability to deliver email. If your confirmation does not arrive on time or at all, then you must ask us to resend the email confirmation of the tours you have paid for.

  4. All internet bookings will be confirmed by email.

  5. We reserve the right to sell any places reserved without a deposit.

  6. It is the responsibility of the passenger to check the accuracy of dates booked upon receipt of their travel documents.

 

2. Insurance

  1. There is no travel insurance cover included in the price of the tour.

  2. We take no responsibility for any injuries or loss to you incurred whilst you are taking part in any optional activities that are outside our all inclusive package. We strongly recommend that you take out comprehensive insurance cover for cancellation, medical expenses, personal accident, personal baggage, money and public liability before you travel. You may not be accepted as an ' Four Elements Adventure ' adventurer unless you have arranged satisfactory insurance. We accept no responsibility for the theft, loss or damage to personal belongings at any time during the duration of your tour.

  3. We offer the opportunity to purchase Travel insurance through our website.

  4. Insurance must be purchased to join the tour. Your insurance must be up to our standard and can be rejected.

  5. We (Four Elements Adventure) take no responsibility for any injuries, theft or lost to property during any of our tours. Though we will take every cautionary detail to keeping you safe at every moment with a heavy emphasis on safety briefings before every activity.     

 

3. Cancellation

  • Multi day tours 
  1. For all Multi day tours, cancellation of your booking must be in writing or by email to Four Elements Adventure. When written notification has been received by Four Elements Adventure a fee of $50 will be levied to cover administration costs.
  2. You are entitled to a full refund only if you give us more than 30 days notice of your intention to cancel.

  3. You are entitled to a 50% refund if you give us 30 days notice of your intention to cancel.

  4. If you choose to cancel 30 or less days before the start of your tour, no refunds will be granted. You can choose to change your tour departure to another date (subject to availability). Permission to do these 48 hours before departure is subject to a €$25 fee and is entirely at the discretion of the Four Elements Adventure Management.

  5. If the reason for your cancellation is covered under your insurance policy, you may be able to make a claim under that policy.

  • Day tours
  1. For cancellations of day tours an email must be given 12 hours prior to start date with cancelation. If there is no email or any attempt to advise about cancelation you will be charged a cancelation fee of $40.00 which will be sent in an invoice. 

 

4. Changes by us

  1. We reserve the right to change our typical itineraries at any time and at our discretion. As professionals we will endeavour to avoid this and if this is necessary, we will substitute alternative arrangements of comparable monetary value.

  2. We reserve the right to alter our itinerary in the event of happenings outside the control of Four Elements Adventure. This includes customers or guide becoming ill or other contagious diseases, revolution, national or local strikes and/or protests, social disorder, political unrest.

  3. We are constantly striving to make our tours even more brilliant than they are perceived by many to be, therefore should attractions open or become open to us, that we feel will enhance your experience of our beloved Island then we reserve the right to include these in your best interests.

  4. We reserve the right to increase or decrease the price of our tours at any time.

 

5. Travelling

  1. You must obey the laws of the respective country you are in, whilst travelling on our tours. We would ask you to show respect to the many diverse customs that exist in Indonesia and Bali and also foreign exchange restrictions. If you do not do so, you may be asked to surrender your ticket, which may be cancelled without any refund. It is our representative who will decide to cancel your pass or not and their decision will be final.

  2. Your appointed Four Elements Adventure Tour Guide may need to make a decision in the interests of safety. It is a condition of bookings that you comply with the authority and decisions of the appointed representative of Four Elements Adventure. If you do not comply with the said representative and are not compatible with the general enjoyment and well being of members of the tour, we reserve the right to refuse to allow you to continue the tour. In such a case we will not be liable for any refund, compensation or any additional costs incurred by you. We cannot accept liability for the behaviour of others on your tour nor if any facilities are curtailed as a result of their actions.

  3. It is your responsibility to meet your tour at arranged points. Because of the nature of the service, Four Elements Adventure will not be liable if any service leaves or arrives later than its specified time, even if as a result you miss a connecting service.

 

6 Acceptance of Risk

  1. You acknowledge that there is a significant element of personal risk in participating in the tour. You accept and consent to the personal risks inherent in the implementation of this Contract, and accept the limitations of the Company’s liability set out herein as being reasonable. Four Elements Adventure reserves the right at any time to require you to produce a doctor’s certificate certifying that the Client is fit to participate in the tour.


 

7 Release and waiver of Liability, Assumption of risk and Indemnity Agreement.

  1. In consideration of participating in the Tour/Activity, you represent that they understand the nature of this Tour/Activity and that they are in good health and in proper physical condition to participate in such a Tour/Activity. You acknowledge that if I myself believe that if event conditions are unsafe they will immediately discontinue participation in the Tour/Activity and all activities can be participated at my own pace.

  2. You fully understand that this Tour/Activity involves risk of serious injury, which may be caused by your own actions or inactions, those of others participating, the conditions in which the event takes place, or the negligence of the “Release’s” named below; and that there may be other risks either not known or not readily foreseeable at this time and they fully accept and assume all such risks and all responsibility for losses, costs and damages they incur as a result of their participation in the Tour/Activity.

  3. You hereby release, discharge and covenant not to sue Four Elements Adventure, its respective administrators, directors, agents, officers, volunteers and employees, other participants, any sponsors, advertisers.

  4. Make sure you have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT and understand that they have given up substantial rights by booking the tour and have agreed to this freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
